Furthermore, you must respect these rights and comply with the restrictions outlined in these Terms and Conditions. Accordingly, you may not copy, reproduce, distribute, or use any content without our prior written permission.

When you provide your personal information through this contract, you agree that we may collect, record, and retain your information in accordance with our Privacy Policy. Furthermore, we use your information only to provide our services, improve your experience, and meet our legal obligations. 3. Acceptable Use
You must use the umbrella or canopy responsibly and avoid any action that could damage it or reduce its performance. Furthermore, you must not interfere with its availability or accessibility in any way. Therefore, always follow our usage guidelines to ensure safe operation and long-lasting durability.
4. Privacy Policy Terms
Confidential Information
In addition to our online Privacy Policy, these terms also apply to any information you share outside our website, including contract documents and business communications. Therefore, we protect confidential information to prevent unauthorized access, use, or disclosure.
Definition of Confidential Information
Confidential Information includes all data, documents, designs, and materials that have commercial value. Furthermore, you should clearly mark all written information as **”Confidential.”** If you share confidential information verbally, you must provide a written confirmation of its confidential status within a reasonable time.
Exclusions
However, this agreement does not apply to information that:
- Becomes publicly available through no fault of Art New.
- Art New legally knew before receiving your disclosure. Art New receives from a reliable third-party
- source without confidentiality restrictions.
- You disclose with your prior written consent.
5. Art New Commitments
Art New Umbrellas shall maintain your confidential information with the utmost care. Access is restricted to a limited number of employees/parties who must sign non-disclosure agreements. Art New will not copy or disclose your info without written consent and will return all records upon your written request.
6. Duration
Confidentiality obligations remain in effect even after the termination of the agreement until the information is no longer considered a trade secret or you provide written permission for disclosure.
7. Data Protection
Art New guarantees that personal data is protected and used only for specific, legitimate purposes.
8. Agreement Acceptance
By proceeding with the contract, you agree to these terms. The term “Art New” refers to the owner, and “You” refers to the contractor/customer.
9. Material Specifications
- Aluminum: Special thickness (2.5 mm), multi-sized, internally reinforced. The structure is demountable and relocatable.
- Motors: Somfy (French or Polish made) with remote control.
- Fabric: Belgian PVC or high-quality national fabric.
- Lighting: Samsung LED system (multiple colors).
- Accessories: Turkish-made from “Kadir Metal” factory.
10. Supply and Installation
Installation takes 50 days from the date of drawing approval and receipt of the first down payment.
11. Warranty and Maintenance Conditions
- The company commits to providing spare parts from the Jeddah showroom or abroad.
- The client must facilitate site access and obtain necessary permits.
- Outside Jeddah, the client must provide safety-compliant scaffolding/lifts.
- Outside Jeddah, the client must provide travel tickets and accommodation for maintenance staff.
- Art New guarantees stability against normal winds, excluding hurricanes or abnormal speeds.
12. Drawing Approvals
No modifications are allowed after drawing approval and the issuance of the manufacturing order. Any changes require a new contract and full payment of the previous one.
13. Limitation of Liability
Art New is not liable for: (a) Indirect or consequential loss/damage. (b) Loss of profit, revenue, or data. (c) Damages arising from events beyond our reasonable control (Force Majeure).
14. Indemnity
You hereby indemnify us against any losses, damages, or legal costs resulting from your breach of these terms.
15. Variations
We may update these terms from time to time. The updated version applies from the date of publication within the institution.
16. Governing Law
This agreement and any disputes arising from it are subject to the laws of the Kingdom of Saudi Arabia.
